Terms of service

Draft pending legal review: this text is not binding yet.
These terms govern the use of Tokko by organizations (the "Customer") and the people they invite (the "Users"). They are concluded between the Customer and Nocodable (the "Provider"). Creating an organization means accepting them.
The service
Tokko delivers short courses on using AI, as scripted chat conversations, on the web and in Slack. Admins invite Users, follow their progress and export reports, including a report documenting AI literacy measures (article 4 of the EU AI Act).
Accounts
Accounts are personal and use a work email. The Customer designates its admins and is responsible for the people it invites and for keeping access credentials confidential.
Plans and prices
- Free plan: up to 5 active Users, at no cost and with no time limit.
- Team plan: €4 excluding VAT per active User and per month, billed monthly.
- A new organization gets the Team features free for 14 days, then moves to the free plan unless the Customer subscribes.
Prices may change with 30 days' notice by email; the Customer can cancel before the change applies.
Payment
Payment is made by card through Stripe. If a payment fails and is not settled within 15 days of a reminder, the Provider may suspend paid features. Late payments bear interest at the European Central Bank rate plus 10 points, and a fixed recovery fee of €40 (article L441-10 of the French Commercial Code).
Acceptable use
The Customer and Users agree to use the service lawfully, to provide accurate information, not to disrupt the service, and not to copy, resell or extract its content.
Intellectual property
The courses, the software and the brand remain the property of the Provider. The Customer receives a non-exclusive, non-transferable right to use them for its Users for the duration of the subscription. The Customer's data remains its property.
Personal data
The Provider processes Users' training data on behalf of the Customer, under a data processing agreement (GDPR article 28) available on request at privacy@tokkohq.com. The privacy policy gives the details.
AI Act reports
Tokko is one of the measures an organization can take to build its staff's AI literacy, and it keeps the records to show it. It does not by itself guarantee compliance with the AI Act or any other regulation, which remains the Customer's responsibility.
Availability
The Provider makes reasonable efforts to keep the service available and secure, and announces planned maintenance in advance whenever possible. No availability commitment applies to the free plan.
Liability
The Provider is liable only for direct damage caused by its fault. Its total liability is limited to the amounts paid by the Customer in the 12 months preceding the event. These limits do not apply to gross negligence or wilful misconduct.
Term and termination
Paid subscriptions renew monthly and can be cancelled at any time, effective at the end of the current period. The Customer can export its reports before closing its organization; data is then deleted within 30 days.
Changes, law and disputes
The Provider may update these terms and will notify Customers at least 30 days before significant changes. These terms are governed by French law. Failing an amicable solution, disputes are brought before the Paris Commercial Court (Tribunal de commerce de Paris).
